Terms & Conditions
These Terms and Conditions apply to all purchases made by
you, the customer, from us, Marked For Life Limited. By purchasing products from
us, you agree to these terms of sale. Marked For Life Limited have the right to
revise these terms and conditions including prices at any time. We also have the
right to decline service to any individual customer.
1. CUSTOMER SERVICE
We are committed to total customer care and we abide
by the principles of The Consumer Protection (Distance Selling) Regulations
2000. Should you wish to speak to our customer services department, we are open
five days a week from 10.00 am to 6:00 pm.
2. DELIVERY
We aim to deliver our products to you within 48 hours of
accepting your order. Products that are dispatched by our nominated carrier will
require a valid signature as proof of delivery (POD).
Delivery dates are not guaranteed, but we will make every
reasonable effort to ensure that goods are delivered within 14 days
(International orders may vary). Please contact our customer services department
for advice.
3. AVAILABILITY
All orders are subject to availability. Where you have
ordered multiple products and not all are in stock, we may send you the products
which are available; we will send the remainder of your order as soon as the
stock becomes available. If the goods ordered are out of stock, we will contact
you within 30 days from the day after your order was placed to inform you. If
the goods are coming back into stock, we will propose a new delivery date. With
your agreement we may be able to supply you with substitute goods. If we have
received payment from you for goods out of stock, or you do not wish to wait for
goods to become available, and/or decline our offer of substitute goods, we will
refund any monies due, within 30 days.
4. VAT
Prices in our catalogue and on our website, all include VAT
at the appropriate rate. For VAT refunds (where applicable), please contact our
customer services department.
5. WAYS TO PAY
Marked For Life Limited customers must be 18 years of age or
over. You will be asked to provide your personal details. It is your
responsibility to ensure that the details provided by you for the purpose of
ordering products from us are correct and that you have the necessary credit
limits and/or authority to use the credit or debit card you present to us.
Call us on 0870 7450028 five days week, from 10.00 am to 6.00
pm. Our friendly, trained call centre staff will take your order. Your call will
be charged at national rates.
If you wish to place an order please have your credit or
debit card to hand. We accept Switch, MasterCard, Delta and Visa.
To order by post, please write to us telling us which
product you wish to purchase. Please enclose a cheque for the amount, made
payable to Marked For Life Limited. Send payment to: Marked For Life Limited, PO
Box 92, Kingswood, Bristol, BS30 8ZA.

6. RIGHT TO CANCEL
You have a right to cancel your order within 7 days of the
goods being delivered to you. Please call our customer services department,
should you change your mind.
7. CANCELLATION & RETURNS
We offer a 30-day money back guarantee, excluding postage.
Should you wish to return any products to us, please contact
our customer services section by telephoning 0870 7450028 to obtain a returns
reference number (RMA). A return will only be accepted if this number is quoted
and sent to Marked For Life Limited, Returns Dept, PO Box 92, Kingswood,
Bristol, BS30 8ZA.
If you are canceling because of any problem with the goods,
please notify us of the problem at the time of cancellation.
We ask that you return the goods to us via the Post Office.
Please use the original shipping box and packaging materials to return the
item(s) safely.
Provided the goods are in good condition we will issue
you with a refund within 30 days upon receipt of the cancellation notice, either
by telephone or in writing.
8. STATUTORY RIGHTS
To obtain a refund, you are obliged to return the goods to
us in the same condition as they arrived. So that there is no doubt, anything we
say in relation to returns above, does not apply to any claim that any goods do
not meet a standard required by law.
9. LIABILITY
If you have notified us of a problem with the goods, we will
either make good any shortage or non-delivery, replace or repair any goods that
are damaged or defective upon delivery, or refund you with the amount paid for
the goods. We will not be liable to you for any loss of profits, administration
inconvenience, or disappointment. This does not affect your statutory rights as
a consumer, or it is intended to exclude our liability to you for fraudulent
misrepresentation or for death or personal injury resulting from our negligence.
Nothing said or any representation made by any employee,
including but not limited to our customer services staff, should be understood
as a variation of these terms and conditions or as a representation about the
products provided. Our disclaimer of liability shall include but not be limited
to any such misleading and untrue representations.
10. SAFETY DISCLAIMER
For your own safety we recommend that you read carefully all
safety information printed either on the packaging, or in any leaflets that may
be included with the product.
11. ERRORS
Every effort has been made to ensure that the information
supplied is correct at the time of going to press.
12. DATA PROTECTION ACT 1998
Marked For Life Limited is registered as a data user under
the above Act. The company’s registered entry contains descriptions of the
sources, uses and disclosure of personal data held by the company. Information
supplied by you will be used for administering your account details, and for
promoting goods and services to you. We may, with your consent, disclose your
information to a third party service provider. We may also send you information
about goods and services from other companies. Before we do this, we will ask
you if you wish to receive such offers at the time you place your order by
telephone. If you have not been asked, or if you do not wish to receive these
offers, please contact us. You also have a right to ask for a copy of the
information we hold on you and to have any inaccuracies corrected and to tell us
in writing at the address given above if you do not wish to receive marketing
offers by mail, telephone or any other means
